Art. 2 – Purpose and acceptance

These Terms and Conditions (the "Terms") govern access to and use of the Website, in both its Italian and English versions. By browsing the Website the User accepts them; anyone who does not accept them is asked not to use it.

The Website is for information purposes only and presents LBG's business. It does not allow online purchases, orders or payments.

Art. 3 – Website content

Descriptions, images, features and performance of testing machines, equipment, extensometers, calibrators and services are provided for information only. They do not constitute an offer to the public under Article 1336 of the Italian Civil Code, nor any contractual commitment.

LBG keeps the content up to date with care, but does not guarantee that it is always complete, accurate or current. Binding specifications and conditions are only those in the written offer accepted by the customer.

Art. 4 – Machines, second-hand equipment and service

New machines, refurbished second-hand equipment, technical service, customisation, revamping and retrofit are supplied only on the basis of a dedicated offer. Availability, condition, warranty and prices of second-hand equipment are those stated in the offer.

Art. 5 – Calibration

LBG is accredited by Accredia as LAT Centre 00115 for the fields listed on the "Calibration Laboratory" page. The calibration service is governed by the terms of supply published on that page and by the offer accepted by the customer.

The accreditation certificate and metrological areas available for download on the Website are current as of their publication date. The current status of the accreditation can be checked on the Accredia website.

Art. 6 – Contact form and requests

Requests sent through the form on the Contacts page or to the e-mail addresses shown on the Website are only meant to put the User in contact with LBG or to obtain an offer. They do not constitute an order and do not bind either the User or LBG.

The User undertakes to provide truthful data and not to enter third-party data without being entitled to do so.

Art. 7 – Rules of use

The User undertakes to use the Website lawfully and not to:

  • interfere with its operation or attempt unauthorised access;

  • extract content in bulk or by automated means;

  • transmit unlawful, offensive or harmful content through the Website (viruses, spam and the like).

LBG may suspend or discontinue the Website, in whole or in part, even without notice.

Art. 8 – Intellectual property

Texts, News articles, graphics, logos, images, videos and documents on the Website belong to LBG or to their respective owners and are protected by copyright and trademark law. The Accredia trademark belongs to its owner.

Reproduction, even partial, is prohibited without LBG's written consent, except for personal use and quotation with acknowledgement of the source.

Art. 9 – Downloadable documents

Documents available for download on the Website are provided for information purposes. They may not be altered or used in a way that suggests an accreditation or certification other than the actual one.

Art. 10 – Links to external websites

The Website contains links to third-party websites, including remet.it, european-accreditation.org, LinkedIn and YouTube. LBG does not control those websites and is not responsible for their content or their processing of personal data.

Art. 11 – Limitation of liability

Except in cases of wilful misconduct or gross negligence, LBG is not liable for damage arising from:

  • the use of information published on the Website;

  • interruptions, errors or unavailability of the Website;

  • viruses or malfunctions of the User's systems;

  • the content of linked external websites.

Art. 12 – Privacy and cookies

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR), as described in the Website's Privacy Policy and Cookies Policy.

Art. 13 – Changes

LBG may amend these Terms at any time by publishing the new version on this page. Changes take effect from the date of publication.

Art. 14 – Governing law and jurisdiction

These Terms are governed by Italian law. The Court of Bergamo has jurisdiction over any dispute, except where the law mandatorily provides for a different court.

If any provision is held invalid, the remaining provisions remain in force. In case of discrepancy between the Italian and English versions, the Italian version prevails.
